The Demise of the 28-Clause Ceasefire Plan for Ukraine: Why Peace Negotiations Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the diplomatic emergency caused by the introduction of a new 28-article proposal for achieving ceasefire appeared – momentarily – to have been stabilised. A Washington representative spoke of "notable headway" after bilateral negotiations in Geneva. On Monday night, Moscow made its retaliation: another massive barrage of rocket attacks on Kyiv.

The Cycle of Diplomacy and Destruction

The chain of conflicting incidents captured the grim essence of the recent timeframe. By day, negotiation efforts are waged: positive announcements are delivered from different nations. Considerable effort is expended on restraining specific proposals. By night, the Kremlin brutally reminds the world that, for them, conflict continues to be the key method for achieving "settlement".

Nighttime Reality

As Russia's attack progressed into the early hours of Tuesday, the current condition of Ukraine's defenselessness was laid bare. Ukraine is able to track rocket firings from Russian territory, a capacity provided through current data. From vantage locations, defense planes that had been dispatched to engage hostile guided weapons streaked across the sky – advanced fighter aircraft supplied to Ukraine by NATO members.

Moments later, Kyiv's air-defence systems activated: multiple launches deployed against a hostile projectile. This was a sophisticated defense system at work, most likely delivered by partner states. Every firing shakes the surroundings, shaking the windows. The instant of fear quickly transforms into grim resignation: perhaps the incoming missile won't hit its mark this time, preventing destruction from catastrophe and further power outages.

Persistent Threats

Soon after, a automatic firearm fired at a aerial vehicle close by, part of a mobile-fire group – probably imported technology. Regrettably, the shots failed to hit the opposing UAV – it maintained course toward its target.

Periodically, this persisted until dawn. Kyiv awoke to the morning news: multiple fatalities, devastation and infrastructure problems in many homes as a result of the evening attack. As customarily, everyone still maintained normal activities – living the war. But those 24 hours demonstrated Ukraine's critical military reliance on external assistance – a reliance that European nations are evidently unprepared to fill in the near term.

Ineffective Peace Efforts

The detailed framework from American leadership provoked deep reactions, debate and serious worry – and briefly redirected concern from Ukraine's largest corruption scandal in years. Yet, we have witnessed similar scenarios, after earlier high-level meetings and multilateral gatherings.

Every new proposal from American administration follows the identical sequence: a political offensive against Ukraine, which Kyiv, with allied governments, succeeds in resisting. They contain the crisis but never actually secure success. This pattern will, undoubtedly, continue.

Strategic Calculations

It is convenient to criticize certain parties of persistently promoting Russian terms. But that does not seem to be the entire situation. Washington functions according to a principle familiar among experienced diplomats: you cannot secure via talks what you have been unable to protect through force. The American government presumes that it is impossible to force Russia to abandon the land that it currently occupies in Ukraine's southern or eastern regions.

The issue is that while recognising this factual reality, US leadership does minimal to discourage Russia, through words or deeds, from thinking that the situation will not change more in its favour in the coming year.

Opposing Positions

Therefore, the Kremlin is confident that duration works to their advantage – that Ukraine and its supporters are approaching exhaustion. Their incentive to sign a deal that does not give them the greatest potential benefit is virtually nonexistent. There may be multiple initiatives to achieve ceasefire, but they will continue as long as Russia's leader remains highly assured in the result.

On the contrary, Ukraine's government believes that Ukraine can still endure, slowly losing civilians and areas but avoiding a complete military breakdown until situations evolve in its advantage.

Current Realities

Realistically, there are no genuine requirements for a armistice. Now, subjective factors are coming into play: leadership ambitions to mediate resolution and secure international recognition, and Kyiv's dual difficulties – on one hand, not to distance important partners, and on the other, to unite the population around the country's interests against any initiative Kyiv finds unacceptable, so that their focus does not move to domestic problems. And although their task will now be considerably more difficult after latest incidents, it remains highly unlikely that this will alter their fundamental strategy.

These conflicting dynamics are driving the talks.

Summary and Prospects

It took a only one week to terminate the 28 points of the current initiative. Aggressive and erratic handling of the matter by US administration, resistance by Ukraine and the other European countries, along with calming attempts of diplomats, and finally, current information leaks, all did their job.

While new initiatives based on old ideas are approaching, Kyiv, London and other Western governments should reach an essential realization: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are founded on Moscow's terms and show particular unwillingness to alter the situation, if they remain united and strengthen their defence capabilities at a much faster pace. If they do, neither political nor armed coercion will be able to defeat them. In the meantime, Ukraine's ability to counter nocturnal attacks will, for the foreseeable future, primarily depend on continued Western support.
